360 ̊ PHOTOGRAPHY/360 ̊ VIDEO BOOKING AGREEMENT
ENTIRE AGREEMENT: This agreement contains the entire understanding between Nevin Photography and the Client.
It supersedes all prior and simultaneous agreements between the parties. 2. Google Maps Street View – Trusted Program. As a Service Provider Nevin Photography is an independent contractor and Nevin Photography is not a Google employee or agent, but is a Google Trusted Photographer authorised under the Google Maps Street View – Trusted Program to provide photography services to local businesses that desire to participate in the Street View – Trusted Program.
Service Fee Payment. Nevin Photography and Business Client will agree on an amount for the Street View – Trusted and
services (“Service Fee”), and the Business Client will pay the Service Fee before the Service Provider takes the
Photographs.
360 ̊ RESERVATION/PAYMENT/DEPOSIT: A signed agreement and payment fee are required to reserve the specified
coverage.
Payments are via Electronic Bank Transfer.

COVERAGE: The Photography/Videography schedule and selected methodology are designed to accomplish the
goals and wishes of the Client in a manner enjoyed by all parties. The Photographer/Videographer shall be
granted artistic license in relation to the views recorded and the locations used. The photographer’s judgment
regarding the location, shots and number of photographs taken shall be deemed correct. Photographs/Video taken
during the course of the event will be at the discretion of the Photographer/Videographer, although every effort will
be made to comply with the Client’s requirements. Creative aspects such as shooting and editing style are at the
discretion of Nevin Photography. Nevin Photography will be the exclusive professional Photographer/Videographer.
Nevin Photography will not be held liable for any production problems beyond our control, e.g. bad
weather, accidents, poor acoustics/lighting, interference from staff/customers, etc.
The area from which the Photographer/Videographer is able to cover may not be the photographer’s choice, and the
Photographer/Videographer cannot accept responsibility for any obstructed view should this be the case. The use
of artificial lighting may also be restricted or prohibited. In addition, Nevin Photography is not responsible if key
individuals fail to appear or cooperate during Photography/Videography sessions, or for missed scenes due to details not revealed to Nevin Photography.
COPYRIGHT: This applies to the Irish Copyright & Related Rights Act 2000,as below.
Title to all images – photographic prints, transparencies or film, and digital or electronic images, and other material
whether analogue or digital, delivered to the client, remain the property of the photographer/videographer Nevin Photography.

CANCELLATION FEES: In the event of client cancellation, a Booking Fee of €300 is charged and is non-refundable. It shall be
liquidated damages to Nevin Photography in the event of a breach of agreement by the Client.

COOPERATION: Client and Nevin Photography agree that cheerful cooperation and punctuality are essential.
The expectation is that the client or their authorised representative will be present during the shoot, if the client is not able to be present Nevin Photography will use their experience to interpret the clients expectations and all works produced will be deemed correct.
Shooting commences at the scheduled start time. There is a danger that third parties can unwittingly spoil shots.
The Client agrees to have the area to be photographed/videoed to be ready, clear and presentable in advance.

MODEL RELEASE: The Client hereby grants and assigns to Nevin Photography and its legal representatives, the irrevocable and unrestricted right to use and publish photographs of the for –portfolio use. Any individuals images captured in the photographs will have their faces blurred as per Google professional guidelines unless a written model release is provided in advance to Nevin Photography prior to uploading their images to Google Maps -Streetview

LIMIT OF LIABILITY: In the unlikely event that the Photographer/Videographer is injured or becomes too ill to photograph/video the event, Nevin Photography will make every effort to secure an alternative time suitable to the Client and Nevin Photography.
If the situation should occur and a suitable alternative times are not found, responsibility and liability is limited to the return of all payments received for the event package. Nevin Photography takes the utmost care with respect to exposure, transportation, and processing the photographs/video. However, in the
unlikely event that photographs/video have been lost, stolen, or destroyed for reasons within or beyond Nevin Photography control, Nevin Photography’s liability is limited to the return of all payments received for the event package. The limit of liability for a partial loss of originals shall be a prorated amount of the scenes lost based on the percentage of total number of originals.
Other images: No photos or images taken by third parties, friends or staff other than the photographers work will be added or attached to Google Maps or Streetview Nevin Photography’s account.

360 ̊ VIDEO: Nevin Photography is in full charge of how the editing and final Video will be displayed. Camera and editing style is at the discretion of Nevin Photography. The videographer retains total editorial control at all times,
No Video preview is ever provided. Any requests by the client for re-edited Video changes will be priced accordingly.

COMPLETION SCHEDULE: The client’s images will be provided and uploaded within seven days of a 1-5 photosphere shoot and within 14 days for larger locations.

POST PRODUCTION:
Post production includes colour balance and light editing as advised by Google and Streetview professional standards for image uploading to their servers.

The Client accepts and understands that changes cannot be made unless agreed by Nevin Photography in writing within seven working days. On payment of the agreed fee to Nevin Photography the Client understands and accepts that this Booking Agreement becomes effective immediately.
