WEDDING PHOTOGRAPHY/VIDEO BOOKING AGREEMENT

ENTIRE AGREEMENT: This agreement contains the entire understanding between Nevin Photography and the Client.

It supersedes all prior and simultaneous agreements between the parties. The only way to

add or change this agreement is to do so in writing, signed by all the parties. If the parties want to waive one

provision of this agreement that does not mean that any other provision is also waived. The party against whom a

waiver is sought to be effective must have signed a waiver in writing.

RESERVATION/DEPOSIT: A signed agreement and reservation fee (deposit) are required to reserve the specified

coverage. Deposit will be €300 non-refundable. Make Cheque/Postal Order out to ‘Tomás Nevin’. Deposits are

also acceptable via Electronic Banking. Bank transfer details are available on request.

In the event that more than one client wishes to book wedding services on the same day, preference will go to the

first client to pay the deposit. Rescheduled weddings will only be accommodated if the new date does not conflict

with another booked wedding.

COVERAGE: The Photography/Videography schedule and selected methodology are designed to accomplish the

goals and wishes of the Client in a manner enjoyed by all parties. The Photographer/Videographer shall be

granted artistic license in relation to the poses recorded and the locations used. The photographer’s judgment

regarding the location, poses and number of photographs taken shall be deemed correct. Photographs/Video taken

during the course of the event will be at the discretion of the Photographer/Videographer, although every effort will

be made to comply with the Client’s requirements. Creative aspects such as shooting and editing style are at the

discretion of Nevin Photography. Nevin Photography will be the exclusive

professional Photographer/Videographer. Friends and family are permitted to operate video cameras on the

condition that they do not interfere with or get in the way of the professional coverage.

Nevin Photography will not be held liable for any production problems beyond our control, e.g. bad

weather, accidents, poor acoustics/lighting, interference from guests, etc.

The Photographer/Videographer shall endeavour to capture all the moments throughout the day as they occur.

However, because of the fluid nature of the event, some moments might not be recorded, or not recorded for

logistical reasons. For a booking involving a church ceremony or at certain venues – the priest, minister, or hotel

manager sometimes restricts the Photographer’s/Videographer’s movements. The area from which the

Photographer/Videographer is able to cover may not be the photographer’s choice, and the

Photographer/Videographer cannot accept responsibility for any obstructed view should this be the case. The use

of artificial lighting may also be restricted or prohibited. In addition, Nevin Photography is not responsible if key

individuals fail to appear or cooperate during Photography/Videography sessions, or for missed scenes due to details

not revealed to Nevin Photography. Due to traffic or other delays, it may not be always possible to capture the bride

and groom arriving at the reception venue.

Title to all images – photographic prints, transparencies or film, and digital or electronic images, and other material

whether analogue or digital, delivered to the client, remain the property of the photographer/videographer Nevin Photography.

and sharing of all provided Photography and Video to the client for personal use only. No commercial use is

allowed unless agreed in advance.

CANCELLATION FEES: In the event of client cancellation, the security deposit paid is non-refundable. It shall be

liquidated damages to Nevin Photography in the event of a breach of agreement by Client.

COOPERATION: The bride and groom agree to set time before the ceremony commencement of the wedding, and

after the ceremony for photographs. If the bride’s or grooms late arrival prevents this from occurring the

Photographer/Videographer shall not be held liable for failure to record desired scenes. Client and Nevin Photography

agree that cheerful cooperation and punctuality are therefore essential to that purpose.

Shooting commences at the scheduled start time. There is a danger that guests can unwittingly spoil shots. This

can be as simple as trying to repeat shots taken by the ‘official photographer’, or distracting the subjects so the

eyes are not looking at the camera, or floating into view on formal set-piece shots, or compromising the ambience

of scenes by the inappropriate use of flash Photography. The Photographer/Videographer Nevin Photography can speak

with the guest or bride or groom or coordinator if appropriate. In some circumstances coverage maybe

compromised or may have to be cut short. An inconsiderate guest, whether family, friend or other, can spoil the

record of your special day – they need to be aware that you have hired a professional Photographer/Videographer

in commissioning your wedding day. The activity of another professional, freelance or videographer or enthusiast

hobbyist can endanger the quality of the final product.

MODEL RELEASE: The Client hereby grants and assigns to Nevin Photography and its legal representatives,

the irrevocable and unrestricted right to use and publish photographs of the Client (Bride, Groom, Wedding Party)

and other parties (guests etc) at this commission, in which the Client or other may be included for –portfolio use

i.e. non-commercial use.

LIMIT OF LIABILITY: In the unlikely event that the Photographer/Videographer is injured or becomes too ill to

photograph/video the event, Nevin Photography will make every effort to secure a replacement

photographer. If the situation should occur and a suitable replacement is not found, responsibility and liability is

limited to the return of all payments received for the event package. Nevin Photography takes the

utmost care with respect to exposure, transportation, and processing the photographs/video. However, in the

unlikely event that photographs/video have been lost, stolen, or destroyed for reasons within or beyond Nevin Photography

control, Nevin Photography’s liability is limited to the return of all payments received for the event package. The limit of liability

for a partial loss of originals shall be a prorated amount of the scenes lost based on the percentage of total number of originals.

Other images: No photos or images taken by family, friends or guests other than the photographers work will be added or attached

to the album or Video.

VIDEO & DVD DESIGN: Nevin Photography is in full charge of how the editing and final Video will

be displayed. Any titles or credits must be supplied prior to the wedding date to be included in the Video titles. Music

must be supplied by client for inclusion in the Video prior to the wedding date. If the clients omit to send their own

music for the soundtrack the music will be added at the discretion of the Videographer. Camera and editing style is

at the discretion of Nevin Photography. The videographer retains total editorial control at all times,

no Video preview is ever provided. Any requests by the client for re-edited Video changes will be priced accordingly.

Video is provided in a digital format on USB. Other Video playback products if requested are available at additional cost i.e. DVD, Blu Ray or Flash hard drives and must be requested in advance.

ALBUM DESIGN: For all albums; the client will receive a PDF of the album in its completed form for proofing

before it is sent to the Lab. Once the client has agreed their approval of album design no further changes can be

made. The client can choose up to the maximum number of images as per photography package details.

PARENTS ALBUMS: The client will not receive a PDF design of these albums. As they are either single

photographs or a smaller version of the main album and do not require design layout consultation or approval

before going to print.

COMPLETION SCHEDULE: The client’s USB of images will be sent within 35 days of the wedding date. Upon

receipt of client’s USB of images the client must provide a list of their chosen images returned to Nevin Photography

within 8 weeks for album design. After the client has made final decisions on the layout of the album and images,

PDF proof, the album and any other products including Video will be ready for collection within 6-8 weeks.

A late fee may apply to the client as album prices and Lab prices fluctuate if a client contacts Nevin Photography later

than 8 weeks after receiving their images.

Clients are responsible for returning their selection of photos for the Wedding Album production, following receipt of

images, and within 12 months of the Wedding Date. The Wedding Album(s) will not be completed any later than

12 months following the wedding date. Outstanding orders following 12 months after wedding date, will incur an

additional charge for late post production costs.

POST PRODUCTION CONSULTATION: If the client cannot choose the images or layout for themselves on their

own time, a post production consultation is available at €100 per hour or part of.

Estimated date of Finished Album will be 6-8 WEEKS AFTER FINAL ALBUM APPROVAL WITH THE CLIENT. All

product orders will be ready for collection at the same time i.e. Albums, Video etc. and will NOT be

supplied separately.

Album/Video products must be collected from premises of Nevin Photography.

For clients unable to collect their products from Nevin Photography the client will be charged cost

of registered postage and packaging to their requested location via PayPal invoice.

I have read, understood and agree to the terms above. Our signatures on the Booking Form confirm we understand

and accept this agreement. We also understand that changes cannot be made unless agreed by Tomás Nevin

Photography & Video in writing within seven working days. I hereby agree to the above and this agreement

becomes effective immediately.
